A. Accessing the Website

By accessing or using our website, you confirm that you’re of legal age in your country or region, and if you're acting on behalf of a company or organization, that you have authority to do so.

You’re responsible for all equipment, software, and any fees associated with accessing the site.

2. Intellectual Property

All content on this website—text, images, design, and functionality—is the exclusive property of Montauk or its partners. You are granted a limited, non-transferable, and revocable license to use the site for personal purposes only. No content may be copied, altered, or reused without our prior written permission.

B. Purchasing Products

6. Product Information & Pricing

We aim to describe our products accurately, but images are for illustrative purposes only. Prices are listed in Swiss francs (CHF) and include Swiss VAT unless otherwise noted. Foreign exchange rates may apply for international clients and may affect refunds.

Product availability is subject to change, and prices may be updated at any time.

7. Payments

Payments must be made in CHF using the methods listed on the website. For products over CHF 3,000, financing options may be available through our third-party partners, with separate agreements and conditions.

8. Placing an Order

To place an order, you’ll need to provide accurate billing and shipping details. Once payment is made, you’ll receive an order confirmation. If an item is no longer available or there are issues with your order, we will notify you promptly.

9. Delivery & Inspection

Products will be delivered to the address provided. Delivery times are estimates and may vary. Upon receipt, inspect your product immediately. Any issues must be reported within 10 calendar days of delivery.

10. Returns & Exchanges

Unless stated otherwise, you may return products within 10 days of delivery, provided they are in original, unworn condition. Special orders or personalized items are excluded. Return shipping is at your expense unless the item was misrepresented.

11. Warranty

New watches are covered by the manufacturer’s warranty. Pre-owned watches are guaranteed for one year if the original warranty has expired. Damage due to misuse or wear is not covered.

C. Selling or Trading In Your Watch

12. Valuation & Process

Our purchase or trade-in offers are provisional and subject to inspection. All watches are verified via The Watch Register. If flagged as lost or stolen, we are obligated to retain the watch and notify authorities.

Valuations may change if your watch’s condition or specifications differ from those described.

13. Payment

Payments are made in CHF to the account details you provide. You’re responsible for ensuring those details are accurate. If issues arise regarding the watch’s authenticity or ownership, we may rescind the transaction and require repayment.

14. Shipping Your Watch

You can choose to send your watch yourself or request a free pickup (within Switzerland). Items must be securely packaged. For inaccurate descriptions, return costs may be charged to you. Duties and taxes for international shipments are your responsibility.

15–17. Condition, Authenticity, and Your Responsibility

You confirm that your watch is genuine, fully owned by you, and free of any legal claims. You are liable for any misrepresentation or omissions. If your watch does not meet our requirements, we reserve the right to cancel the agreement and seek compensation.

Our Privacy Policy explains how we handle your personal information. Please read it carefully—it forms part of these Terms.

20. Liability

We are not liable for indirect damages or losses unless legally required. Our liability, where applicable, is capped at the value of the product or service provided.
